Beta Testing Terms and Conditions

These Beta Testing Terms and Conditions apply between THE SELF-SCIENCE LAB LIMITED a company registered in England and Wales (company number 12831037) whose registered office is at 3rd Floor, 45 Albemarle Street, Mayfair, London, W1S 4JL , United Kingdom, N14 5BP ("TSSL") and you ("Client"). TSSL and the Client are each a "Party" and together "Parties".

By participating in the beta testing program ("Beta Program") for the Reduce Stress @ Work ("Product"), the Client agrees to the Terms and Conditions as set forth below.

These Terms and Conditions, set out the entire agreement ("Agreement") between the Parties and no prior correspondence or conversations shall have any effect.

 

1.     Purpose of the Beta Program

The purpose of the Beta Program is to evaluate the performance, functionality, usability, and comprehensibility of the Product, as well as customer satisfaction with the product before it is officially released. The Product provided during the Beta Program is provided for limited evaluation only.

2.     Confidentiality

The Client agrees that all information related to the Product, including but not limited to its content, features, design, performance, and issues encountered, is confidential. The Client agrees not to disclose this information to any third party.

3.     License to Use

TSSL grants Client a limited, non-transferable, non-exclusive, revocable license to access and use the Product for testing purposes only during the Beta Program. This license will terminate upon the conclusion of the Beta Program.

4. Disclaimer

The coaching services and information provided through this course are designed to support personal development, mental well-being, and self-improvement. The information provided, including but not limited to health, mental health, emotional state, wellness, breathing exercises, and other related content, is for informational purposes only and does not constitute professional medical advice, diagnosis, or treatment. It does not replace or serve as therapy, counseling, or medical advice. If you have specific health or mental health concerns, it is essential to seek help from a licensed medical or mental health professional. While we strive to offer accurate and up-to-date information, we make no representations or warranties regarding the completeness, accuracy, or reliability of the information provided.

5.  Feedback

The Client agrees to provide reasonable written feedback to TSSL regarding the Product within a deadline of 15 days after termination of the Beta Program. The feedback includes information on the customer experience, the reporting of difficulties, including regarding comprehensibility of the Product, the reporting of bugs, suggesting features, or providing general observations and evaluation. To submit the feedback, TSSL provides the Client with a corresponding form to be completed by the Client.

TSSL may freely use any feedback, suggestions, or ideas provided during or after the Beta Program for the improvement of the Product, with no obligation to compensate Client. If the feedback results in an improvement to the Product and that improvement affects the intellectual property rights or other rights of TSSL, all such improvements shall vest in TSSL.

6. No Warranty

The Product is provided "as-is" without any warranties, express or implied, including but not limited to warranties of fitness for a particular purpose. TSSL does in particular not guarantee any specific outcome, results or benefits from the use of the Product and the advice provided therein.

7.     Limitation of Liability

To the maximum extent permitted by law, TSSL will not be liable for any damages of any kind, including direct, indirect, incidental, consequential, or punitive damages, arising out of your use of or inability to use the Product during the Beta Program. TSSL will in particular not be liable for the implementation of any ideas, methods or plans provided as part of the Product, or for any other outcome of the Product.

8.     Data Collection

By participating in the Beta Program, the Client agrees that TSSL may collect, process and store personal data in accordance with any applicable data protection laws, in particular in accordance with the Swiss Federal Act on Data Protection (FADP), the EU General Data Protection Regulation (Regulation (EU) 2016/679) (GDPR), the UK Data Protection Act 2018, and any related privacy and data protection laws and regulations in force from time to time in the European Union and the United Kingdom, including the UK GDPR (as incorporated into UK law pursuant to the European Union (Withdrawal) Act 2018).

9.     Data Protection

By participating in the Beta Program, the Client agrees that TSSL may collect, process and store personal data in accordance with any applicable data protection laws, in particular in accordance with the Swiss Federal Act on Data Protection (FADP), and GDPR for European countries.[HS3] 

Personal data of Client will only be used for purposes of improving the Product, and will not be shared with third parties, unless required by law.

The Client has the right to request information on the processing of its personal data, request correction of inaccurate data, or request deletion of personal data, in accordance with the FADP, and GDPR.

10.     Termination

TSSL reserves the right to terminate the Client’s participation in the Beta Program at any time, for any reason, without prior notice. Upon termination, the Client must cease all use of the Product and destroy any copies in its possession.

11.  Intellectual Property

The Company retains all right, title, and interest in and to the Product, including any improvements, updates, and derivative works. Participation in the Beta Program and providing valuable feedback to the Product and the Product’s improvement does not grant the Client any ownership or other rights whatsoever to the Product.

12.  Governing Law

This Agreement shall be governed by and construed in accordance with the laws of Switzerland, excluding the provisions of international private law and other conflict of law rules.

Any disputes arising from this Agreement shall be subject to the exclusive jurisdiction of the courts of Zurich, Switzerland.

13.  Severability Clause

If any provision of this Agreement is found to be invalid, illegal, or unenforceable under Swiss law, the remaining provisions of this Agreement shall remain valid and enforceable. The invalid or unenforceable provision shall be replaced by a valid provision that reflects the intent of the original provision as closely as possible, in accordance with the applicable law.

By participating in the Beta Program, the Client acknowledges to have read, understood, and agrees to be bound by these Beta Testing Terms and Conditions.
